Agtuvi Oy / KIVAT online shop delivery terms

1. GENERAL TERMS AND CONDITIONS
www.kivatshop.com is an online shop maintained by Agtuvi Oy, where the goods are sold by Agtuvi Oy, (Kursonkatu 4, 33840 Tampere, Finland, Tel. +358 (0)44 - 906 0744) Business ID 0153199-7. These terms and conditions shall apply to trade relations between Agtuvi Oy and its customers. These delivery terms are valid indefinitely. Agtuvi Oy reserves the right to change the delivery terms without a prior notice.
Agtuvi Oy shall not be liable for any damage caused by force majeure. An unforeseeable circumstance or change in circumstances beyond Agtuvi Oy's control, including strike or other industrial action, natural phenomena, social unrest or other exceptional circumstances, shall be considered a force majeure. Agtuvi Oy is obliged to notify the customer as soon as possible in the event of force majeure.
www.kivatshop.com sells products and services to individuals of legal age. Currently, orders are available in the following countries: Finland (also Åland), Sweden, Denmark, Estonia, Germany, Austria, Italy and France.
Consumer trade complies with the Finnish and European Union consumer protection legislation in force. These delivery terms shall not apply to the extent that they restrict the consumer's rights under mandatory law.
Delivery time estimates are based on information provided by the material supplier and production. Agtuvi Oy or its material supplier is not responsible for any delays caused by unforeseen changes from outside its area of influence. Binding sales contract will come into force after the customer has accepted these delivery terms and the order has been logged into Agtuvi Oy's system.
3. PRODUCTS AND PRICES
The prices of the products are in Euro (EUR) and include the applicable VAT, which is currently 24%. Prices do not include delivery costs, unless otherwise stated. The prices quoted at the time of ordering at www.kivatshop.com are valid throughout the customer's purchase process. Agtuvi Oy reserves the right to change the prices and delivery costs. Any changes in the prices and delivery costs will only apply to orders placed after the changes take effect. Agtuvi Oy reserves the right to cancel an order in the event of a price error. A clear price error in online shop means that the price of a product is clearly and significantly different from the correct price of the product (for example, if the price of the product is 0.00€). In such a case, the price differs so clearly from the correct price that the customer is deemed to understand the price information as incorrect.
Agtuvi Oy reserves the right to restrict the sale of products in exceptionally large quantities.
Products manufactured or ordered at the customer's request will not be eligible for unilateral cancellation. In the event of cancellation, the full cost of the order will be charged to the buyer.
We cannot guarantee that the colors displayed on the screen will match those of the actual products. The colors displayed depend on the settings of the customer's own computer.
4. PAYMENT METHODS
Payment service provider
Paytrail Oyj (2122839-7) in co-operation with Finnish banks and credit institutions acts as a broker for payment services and as a payment service provider. Paytrail Oyj shall be the receiver on the payer's account statement and shall relay the payment to the seller. Paytrail Oyj has a payment institution license. In the event of reclaims, the product's supplier shall be the first point of contact.

Payments made through Paytrail are mainly via Nets, i.e. the acquirer is Nets.
5. DELIVERY METHODS
Agtuvi Oy takes utmost care in receiving and delivering orders. Agtuvi Oy delivers orders approved by the company promptly and in the order they are received. The average processing time for your order is 1-3 business days after we submit your automatic order confirmation. Delivery time is usually 2-3 business days (Finland and Åland). Other countries approximately one week. If the products cannot be delivered due to the fact that the products are out of stock, or if the delivery is delayed for other reasons, the customer will be notified by email. Agtuvi Oy shall not be liable for any damage caused by exceeding the stated delivery time.
Delivery methods are (in Finland):
Pick up from post office, pick up from parcel locker, Posti's home delivery and pick up from PostNord MyPack location
Delivery costs vary by the delivery method and are visible when you place the order. Any discounts and offers on delivery costs will be automatically taken into consideration when ordering.
The customer is obliged to inspect the shipment within 14 days and to read the washing and care instructions of the product before use.
6. PRODUCT RETURNS
Agtuvi Oy is responsible for ensuring that every shipment is carefully checked before it is sent to the customer. If the customer nevertheless receives a defective or incorrect product, he/she must use the return address card, attach the return card and return the product to Agtuvi Oy.
Products ordered by the customer have a full right of cancellation and return within 14 days of receipt. If the customer is not satisfied with the order and returns the entire order, customer will receive a refund for the value of the entire order. If the customer returns only part of the products, delivery costs will not be refunded. Return shipment is free for the customer, when the customer uses the customer return address label provided. KIVAT charges a return fee for the processing of returns from outside of Finland. The return fee is deducted from the amount that is refunded to the customer. The fee is 7 Eur when the return comes from outside of Finland.
The customer has the right to try the products on, but the returned products must be unused and undamaged and the original tags and labels must still remain on the products.

If the customer wants to replace the ordered product with another product, a new order for the product must be placed. The product being replaced will be returned normally. We normally charge delivery costs for the new product. After we have received the returned product, we will refund the money according to the payment method used to make the purchase.
If order remains unclaimed, it will be returned to KIVAT as unclaimed order, not as returned products. In such cases we will charge 10,00 Eur processing fee.
7. WARRANTY and LIABILITY
The customer is obliged to read the washing and/or care instructions supplied with the product before using the product. Agtuvi Oy reserves the right to verify the defects in the products.
Reclaims will be processed in writing. A free-form reclaim can be submitted by email to: firstname.lastname@example.org
Dispute resolution and court of justice: Disputes will be heard in the district court of Agtuvi Oy’s domicile. Lawyers' fees are not reimbursed because the Finnish Consumer Ombudsman and Consumer Disputes Board provide free assistance in resolving any dispute.
9. PRODUCT and SERVICE LIABILITY
Products and services are always sold as is. Product defect liability is limited to the sales price minus the use performance.
Agtuvi Oy shall not be obliged to fulfil the contract if it encounters a force majeure that it cannot reasonably overcome. Agtuvi Oy shall not be liable for any loss or expense incurred to the customer in the event of force majeure and shall be entitled to cancel the contract.
By placing an order, the customer agrees to these Agtuvi Oy delivery terms.
